Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ariella App Labs ("we", "us", or "our") governing your use of Palette - Color Designer ("the App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the App, you represent and warrant that you meet these eligibility requirements.

6. Subscriptions & In-App Purchases

The App offers "Palette Pro" which unlocks all premium features. You can access Palette Pro through the following plans:

Free Trial: New subscribers are eligible for a 14-day free trial. The trial provides full access to all premium features at no charge. After the trial period, your subscription will automatically renew at the selected plan's price unless cancelled at least 24 hours before the end of the trial period.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

Managing Subscriptions: You can manage or cancel your subscription at any time through Settings → Apple ID → Subscriptions on your device.

Premium features include:

Family Sharing: Subscription plans support Apple Family Sharing. One purchase can be shared with up to five family members.

Payment: All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Prices may vary by region and are displayed in your local currency at checkout.

Refunds: Refunds are handled exclusively by Apple according to their refund policy. We cannot process refunds directly.

Restore Purchases: You can restore your purchases on any device signed in with the same Apple ID using the "Restore Purchases" button in the App.

7. Intellectual Property

Our Property: The App, including its design, code, graphics, logos, and documentation, is owned by Ariella App Labs and is protected by copyright, trademark, and other intellectual property laws.

Your Content: Color palettes you generate using the App are yours to use freely for any purpose, commercial or personal.

Feedback: If you provide feedback or suggestions about the App, you grant us the right to use such feedback without compensation or attribution.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The App may integrate with third-party services (such as Apple Sign-In, Google Sign-In, Firebase Authentication, Firebase Analytics, and RevenueCat). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the App at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIELLA APP LABS SHALL NOT BE LIABLE FOR ANY:

By You: You may stop using the App at any time by uninstalling it and deleting your account.

By Us: We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms or conduct that we believe is harmful to other users or the App.

Effect of Termination: Upon termination, your license to use the App ends. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

If you have a dispute with us, you agree to first contact us at labsariella@gmail.com and attempt to resolve the dispute informally for at least 30 days before initiating any legal action.

17. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ariella App Labs regarding the App.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

No Agency: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and us.
